1. Leave granted.

2. We have heard the learned counsels for the parties.

3. The accused(appellant) No. 14 (Renuka) has been found guilty of commission of offence under Section 302 r/w Section 149 of I.P.C. and sentenced to undergo rigorous imprisonment for life by the learned trial Court. The said order has been challenged before the High Court in appeal along with the application for suspension of sentence.

4. The High Court having refused to grant suspension of sentence to the accused-appellant, the present appeal has been filed.

5. The finding against the accused-appellant is one of conspiracy. No specific overt act has been attributed to the accused-appellant. The accused-appellant is about 29 years old having two children who are aged about 10 and 8 years.

6. Taking into account the totality of the above facts, we are of the view that the accused-appellant should be released on bail to the satisfaction of the learned Additional District and Sessions Judge, Ramanagara at Kanakapura in connection with Session Case No. 179 of 2011. We order accordingly.

7. The learned trial Court is free to impose all such conditions as it may deem fit.

8. The order of the High Court is set aside and the appeal is allowed in the above terms.
