2. Heard learned counsel for the parties.

3. The present appeal is directed against the impugned judgment and order dated 03.09.2024 passed by the High Court of Judicature at Allahabad in Criminal Misc. Anticipatory Bail Application No. 7710 of 2024, whereby the High Court has dismissed the application of the appellant seeking anticipatory bail in connection with case Crime No. 832 of 2019 dated 13.12.2019 registered at Police Station – Robertsganj, District Sonbhadra for the offence under Sections 419, 420, 467, 468, 471, 120B of the IPC.

It is submitted by the learned counsel for the appellant that pursuant to the interim order passed by this Court on 21.11.2024, the appellant has appeared before the Court and has furnished the bail bond also. He submitted that the investigation is over qua the appellant and the chargesheet has also been submitted before the concerned Court and that he is also exonerated in the departmental inquiry in respect of the same allegations, as alleged in the F.I.R.

5. The learned counsel for the respondent – State as such does not dispute the said position that the investigation is over qua the present appellant and he has cooperated with the Investigating Officer, as also submitted the bail bond before the Trial Court.

6. Having regard to the said submissions and without expressing any opinion on the merits of the case, we are inclined to accept the present appeal.

7. Hence, it is directed that in the event of arrest of the appellant in connection with case Crime No. 832 of 2019 dated 13.12.2019 registered at Police Station – Robertsganj, District Sonbhadra for the offence under Sections 419, 420, 467, 468, 471, 120B of the IPC, he shall be released on bail on the terms and conditions that may be imposed by the Trial Court.

8. It goes without saying that any breach of the conditions that may be imposed by the Trial Court for releasing him on bail, shall entail cancellation of the bail.

9. Subject to the afore-stated, the present appeal is allowed.

10. Pending application(s), if any, shall stand disposed of.
